General Terms of Use
The information, documentation, text, photos, graphics, and links are provided by ECi as a convenience to our customers. Please carefully review the following terms, conditions, and legal restrictions concerning your use of Engine Components International (“ECi”) website. By accessing, downloading, using materials and services from this web site you agree to follow and be bound by these terms and conditions.
The materials found on this site are not intended to supersede or supplement FAA approved documents, engine maintenance, and/or operator's manuals. FAA approved manuals must be utilized when performing maintenance and/or operating engines.
Definitions
“Materials” means any ECi, or its associated companies’, content made available by ECi or other users includes, without limitation, any information, technical data, documents, images, photographs, graphics, audio, videos, or webcasts.
ECi makes certain Materials, Document Sharing Services, Email Listing Services and eBusiness Services (collectively, “Services”) available only if you have provided ECi Registration Information (personal and non-personal information) and/or created an ECi ID and password or other log-in ID and password (collectively, “Account Information”).
“Personal Information” is defined as any information that identifies or can be used to identify the person to whom such information pertains. See Online Privacy Policy, for more information.
If you are a registered user of a Service, you are responsible for maintaining the confidentiality of your account and password (“Account Information”). If you use this Site, you are responsible for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. ECi reserves the right to refuse service, terminate accounts, or remove or edit content in its sole discretion.
Some Services may also be subject to a subscription or other agreement, posted guidelines, rules, or terms of service (“Additional Terms”). If there is any conflict between the General Terms and the Additional Terms, the Additional Terms take precedence in relation to that Service. The General Terms and any applicable Additional Terms and all other documents incorporated by reference in these General Terms are referred to herein as the “Terms”.
Acceptance of Terms
By accessing Materials and registering for Services on ECi’s website, you agree that you have read, understand and accept ECi General Use of Terms and the ECi Online Privacy Policy, which is incorporated herein by reference, by:
- using this website or other ECi online services with links to these Terms of Use in any way, including viewing, copying, capturing, using, transmitting, downloading, or uploading any materials made available by ECi; or
- merely browsing the documents, photos, graphics.
In exchange for technical data Materials and Services provided by ECi, you agree to waive, release, and hold ECi and its associates harmless from any injury, loss, damage, or mishap that may result in the use of any ECi Material or Service. You understand that proper skills and training are essential to minimize the unavoidable risks of property damage, serious bodily injury and death that arise from the use of ECi products.
IN PARTICULAR, YOU EXPRESSLY AGREE TO, AND CAREFULLY READ, FOLLOW SPECIFIC INSTRUCTIONS, AND PAY SPECIAL ATTENTION TO ALL SAFETY INFORMATION NOTES, CAUTIONS, WARNINGS, DANGERS, AND STOPS SPECIFIC TO EACH DOCUMENT. IN ADDITION, YOU AGREE TO EACH MATERIAL WARRANTY TERMS THAT YOU CHOOSE TO DOWNLOAD OR USE. YOU UNDERSTAND THAT CERTAIN ACTIONS OR PROCEDURES ARE MANDATORY AND IF IMPROPERLY PERFORMED OR IGNORED MAY RESULT IN ENGINE FAILURE AND/OR SERIOUS PERSONAL INJURY.
ECi may change the Terms from time to time at its sole discretion, including by imposing a charge for access to or use of a Service. If such changes are made, ECi will make a new copy of the General Terms available online, with any new Additional Terms made available to you from within or through the affected Service. ECi may require you to provide consent to the updated Terms in a specified manner before further use of the Services is permitted. Otherwise, your continued use of any affected Service constitutes your acceptance of the changes. Your use of the Services is subject to the most current version of the Terms posted on or through the affected Service at the time of such use. Please regularly check the terms to view the then-current General Terms and Additional Terms.

Use of Materials and Services
Except as expressly indicated to the contrary in any applicable Additional Terms, ECi hereby grants you a nonexclusive, freely revocable (upon notice from ECi), non-transferable, license to view, download and print ECi Materials, subject to the following conditions:

You may access and use the ECi Materials solely for personal, informational, non-commercial and internal purposes, in accordance with the Terms;

The rights granted to you in ECi Materials as specified above are not applicable to the design, layout or look and feel of the of any Services. Such elements of the Services are protected by Intellectual Property Rights and may not be copied or imitated in whole or in part. No ECi Materials may be copied or retransmitted unless expressly permitted by ECi.
You agree to adhere to all limitations on dissemination, use, and reproduction of any Materials that you download or access from the Services.
You may not use the Services if you are prohibited by Law from receiving or using the Services. Also, unless expressly stated in the Additional Terms for any given Service, you may not use the Services unless you are fully able and competent to enter into the conditions, obligations, representations and other terms of these General Terms and are of legal age and mind to form a binding contract with ECi.
You agree that your Account Information will always be complete, accurate, and up-to-date. It is your responsibility to keep your Account Information confidential at all times and you are solely responsible for all activity that occurs to your Account Information when you are logged in to your account. If you become aware of any unauthorized use of your account or Account Information, or any other breach of security, you agree to notify ECi immediately. You may not use another person’s Account Information. ECi may require that you change your Account Information or certain parts of your Account Information at any time for any reason.
You agree to use the Services and the Materials only for purposes that are permitted by the Terms and any applicable law, regulation, or generally accepted practices or guidelines in any applicable jurisdiction (including any laws regarding the export of data to and from the United States or other applicable countries) (“Law”).
Online Privacy Policy
All Personal Information that ECi collects and maintains will be subject to this Privacy Policy, as amended from time to time. ECi may change the Privacy Policy from time to time at its sole discretion and will provide notice of all changes in the Privacy Policy through indications on this webpage.

Collection of personal information
As a visitor to this Site, you can engage in utilize the site without providing any personal information. In connection with selected Services, such as Document Sharing or ECi’s eList Service, ECi may ask you to provide certain information about yourself by filling out and submitting a form and/or survey. It is optional for you to engage in these activities. If you elect to engage in these activities, however, ECi may ask that you provide certain personal information (as well as certain non-personal information that may be tied to personal information), such as your first and last name, mailing address (including ZIP code), country of residence, e-mail address, aircraft, engine model, hours of operation, etc.. Depending upon the activity, some of the information that we ask you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity. Similarly, if you wish to delete your information (pursuant to the mechanism set forth in "Updating your personal information and privacy preferences") that is mandatory, you will no longer be able to engage in that particular activity.
When you use the Site and the Materials and Services, ECi may also collect certain information about your computer to facilitate, evaluate, and verify your use of the Site and the Materials and Services. For example, we may log environmental variables, such as browser type, operating system, CPU speed, referring or exit webpages, click patterns, Session ID (a unique identifier assigned to the browser in connection to the Site), and the Internet Protocol (IP) address of your computer. ECi also uses such information to measure traffic patterns on the Site and usage of the Materials and Services. We do not match such information with personal information held about you by ECi unless we have your consent, except as otherwise described in this Privacy Policy.
By using this Site and the Materials and Services, you agree and acknowledge that personal information collected through the Site or in connection with the Materials and Services that in certain activities, the collection, transfer, storage, and processing of your information may be undertaken by trusted third party vendors or agents of ECi such as web hosting providers, mail and email service providers, communication services, and web analytic providers, to help facilitate ECi in providing certain functions. Another instance where this could occur is in conjunction with framed pages in which the URL for the pages is not visible, and the pages are hosted for ECi by such third party vendors. For example, on the sign up pages for some product announcement and service publication alerts, the pages may be hosted by a third party vendor, but appear to be eci.aero pages and they are therefore governed by this Privacy Policy. Personal information may be shared with these providers to fulfill the service. Such third parties are bound by contract with ECi not to use your personal information for their own purposes or provide it to any third parties.
How your personal information is used
ECi collects your information in order to record, support, and facilitate your participation in the Services you select and to prevent fraud and unlawful use. If you subscribe to or register for Materials and Services, for example, the information is used to register your rights, if any, to technical materials or other services that may be made available exclusively to registered users. Your personal information may also be used by ECi to track your preferences to provide a customized Site experience and keep you informed about product upgrades, special offers, and other products and services of ECi. ECi does not share personal information it receives from you unless ECi has performed business with, or received an opt-in from you.
ECi may collect information about the use of the Materials and Services and the Site, such as the number of downloads, types of Services used, how many users we receive daily, Site pages visited, and the IP address of your computer. This information is generally collected in aggregate form, without identifying any user individually, although IP address and Session ID in relation to purchases and downloads may be tracked as part of ECi’s customer order review and market intelligence efforts. Other exceptions to this, where an individual may be identified individually, are noted in this Privacy Policy or in additional privacy terms connected to a specific Product, Service, or website.
ECi may use collective, statistical data for improving the Site and the Materials and Services, providing more relevant experiences to our customers and for statistical analysis.
Certain Materials and Services may require you to use the most current version of a third party Product or Service offered in conjunction with other Products and Services, which you may or may not have already downloaded. The Product and Service may automatically check to determine if you are using the most current version or have other Products and Services and through e-mail messages, pop-up boxes or similar mechanisms inform you if need to upgrade in order to use the Product and Service you have requested. During this process, an IP address identifying your computer and the Product and Service version may be sent to a Web server, but system profile information is not transmitted.
Your choices with respect to personal information
ECi recognizes and appreciates the importance of responsible use of information collected on the Site and in connection with the Materials and Services. ECi will respect your legal rights regarding access to, and correction and deletion of, your personal information. ECi may communicate information to you regarding products, services, and special offers available from ECi unless you have opted not to receive such communications or such communications are prohibited by law, although in such cases we may find it necessary to continue to communicate with you regarding your use of the Site and the Materials and Services.
There are other instances in which ECi may divulge your personal information, such as when required by law, regulation, or litigation. We may also disclose information about you if we determine that such disclosure should be made for reasons of national security, law enforcement, or other issues of public importance.
Protection of your personal information
The personal information that you provide in connection with registering yourself as a user of the Site Services is classified as Registration Information. Registration Information is protected in several ways. Access by you to your Registration Information is available through a password and unique customer ID selected by you. This password is encrypted. We recommend that you do not divulge your password to anyone. In addition, your Registration Information resides on secure servers that only selected ECi personnel and contractors have access to via password. ECi encrypts your personal information as it is transferred to ECi and thereby strives to prevent unauthorized parties from viewing such information.
Personal information that you provide that does not constitute Registration Information also resides on secure servers and is accessible only to selected ECi personnel and contractors via password. Since this information is not accessible online by you, you will not be asked to select a password in order to view or modify such information.

Ownership
ECi’s Services and Materials are protected by copyright, trademark, patent, trade secret, and other intellectual or intangible and proprietary rights (the “Property Rights”). Except as expressly provided in the Terms, ECi and its associates do not grant any express or implied rights to use the Services and Materials.
You have no ownership rights in the Site, Materials, or in the Services. Rather, you have a license to download, access, view, use and display this Site, Materials, and Services as long as this Agreement remains in full force and effect. Unless otherwise noted, ownership, intellectual and intangible property rights therein shall remain at all times with ECi or their respective owners.
The trademarks, logos, and service marks displayed on the Materials and Services (the “Marks”) are the property of ECi or third parties. You are not permitted to use the Marks without the prior consent of ECi or the third party that may own the Marks.
Airmotive Steel, CermiNil, Double Band, ECi, FREEDOM, Nickel+Carbide, Q3, Q4, Q5, TITAN and TITAN Advanced are trademarks or registered trademarks of Engine Components International and are protected by copyright, trademark and intellectual property laws.
Notice of Copyright Infringement
ECi respects the intellectual and intangible property of others, and we ask our users to do the same. If you believe that your work has been copied and is accessible on this Site in a way that constitutes copyright infringement, please provide ECi’s Marketing Director (marketing@eci.aero) with the following information:
- Webpage link and description of the copyrighted work claimed to have been infringed;
- Identification of the allegedly infringing material on the Site that is requested to be removed;
- Contact information (your name, address, daytime telephone number, and e-mail) so that the marketing department may contact you if necessary;
- A statement that you have a good faith belief that use of the copyrighted work is not authorized by the copyright owner, its agent or the law;
- A statement that the information in the notification is accurate and, under penalty of perjury, that the signatory is authorized to act on behalf of the owner of an exclusive copyright right that is allegedly infringed; and

Modifications to Services and Materials
ECi may at any time and from time to time modify or discontinue, temporarily or permanently, the Services or Materials, or any portion thereof, with or without notice. You agree that ECi shall not be liable to you or any third party for any modification, suspension or discontinuance of the Services or Materials.
Termination of Terms
The Terms will continue to apply until terminated by either you or ECi as set forth below.
If you want to terminate your agreement with ECi, you may do so by (i) notifying ECi at any time, and (ii) closing your accounts for all of the Services or Materials that you use, where ECi has made this option available to you. Your notice should be sent, in writing, to ECi’s Marketing Department at marketing@eci.aero set forth below.
ECi may at any time terminate the Terms (or portion thereof, such as any individual Additional Terms) with you if:
- You have breached any provision of the Terms (or have acted in a manner that clearly shows you do not intend to, or are unable to, comply with the Terms);
- ECi is required to do so by Law (for example, where the provision of the Services or Materials to you is, or becomes, unlawful);
- The provision of the Services to you by ECi is, in ECi opinion, no longer commercially viable;
- ECi has elected to discontinue the Services or Materials (or any part thereof); or
- There has been an extended period of inactivity in your account.
ECi may also terminate or suspend all or a portion of your account and/or access to the Services for any reason. Except as may be set forth in any Additional Terms applicable to a particular Service, termination of your account may include: (i) removal of access to all offerings within the Services; (ii) deletion of Your Content and Account Information, including your personal information, log-in ID and password, and all related information, files and Materials associated with or inside your account (or any part thereof); and (iii) barring of further use of the Services.
You agree that all terminations for cause shall be made in ECi’s sole discretion and that ECi shall not be liable to you or any third party for any termination of your account (and accompanying deletion of your Account Information), or access to the Services and Materials, including Your Content.
Upon expiration or termination of the Terms, you shall promptly discontinue use of the Services and Materials.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH USE OF THE SERVICES IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL. ECI WILL NOT BE LIABLE FOR ANY LOSS THAT YOU MAY INCUR AS A RESULT OF SOMEONE ELSE USING YOUR PASSWORD OR ACCOUNT OR ACCOUNT INFORMATION IN CONNECTION WITH THE SITE OR ANY SERVICES OR MATERIALS, EITHER WITH OR WITHOUT YOUR KNOWLEDGE.
International Users
The Services can be accessed from countries around the world and may contain references to Services and Materials that are not available in your country. These Services are controlled, operated, and administered by ECi from its offices in the United States of America. ECi makes no representation that the Services or Materials are appropriate or available for use at other locations outside the United States, and access to the Services from jurisdictions where the Services or Materials are illegal is prohibited. ECi reserves the right to block access to the Services or Materials by certain international users. If you access the Services from a location outside the United States, you are responsible for compliance with all local Laws.
Limitation of Liability
IN NO EVENT SHALL ECI, ITS OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS OR SUPPLIER NETWORK BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING THOSE RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER OR NOT FORESEEABLE OR IF ECI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR BASED ON ANY THEORY OF LIABILITY, INCLUDING BREACH OF CONTRACT OR WARRANTY, NEGLIGENCE OR OTHER TORTIOUS ACTION, OR ANY OTHER CLAIM ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR ACCESS TO THE SITE, SERVICES OR MATERIALS. NOTHING IN THE TERMS SHALL LIMIT OR EXCLUDE ECi’S LIABILITY FOR GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT OF ECI OR ITS EMPLOYEES, OR FOR DEATH OR PERSONAL INJURY.
Export Control Laws
You acknowledge and agree that products, services or technology provided by ECi are subject to the export control laws and regulations of the United States. You shall comply with these laws and regulations and shall not, without prior U.S. government authorization, export, or transfer ECi products, services or materials, either directly or indirectly, to any country in violation of such laws and regulations.
Indemnity and Liability
You agree to indemnify and hold ECi and its subsidiaries, affiliates, officers, agents, employees, co-branders or other partners, and licensors harmless from any claim or demand, including reasonable attorneys’ fees, due to or arising out of your use of the Services or Materials, your connection to the Services or Materials, the actions of any member of your group, your access to or use of Linked Sites and your connections therewith, any claim that your use of materials and/or services caused damage to you, your property or a third party, any dealings between you and any third parties advertising or promoting via the Services or Materials, your violation of the Terms, or your violation of any rights of another.
Resolution of Disputes
All matters relating to your access to, or use of, the Services or Materials shall be governed by the Laws of the United States of America without regard to conflict of laws principles thereof. You agree that any claim or dispute you may have against ECi must be resolved by a court located in San Antonio, TX, United States of America except as otherwise agreed by the parties. You agree to submit to the personal jurisdiction of the courts located in San Antonio, TX, United States of America for the purpose of litigating such claims or disputes.
Notwithstanding the foregoing, in the event of your or others’ unauthorized access to or use of the Services or Materials in violation of the Terms you agree that ECi shall be entitled to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.
General
Any notice provided to ECi pursuant to the Terms should be sent to 9503 Middlex, San Antonio, TX 78217, Attention: Marketing Department.
ECi may provide you with notices, including those regarding changes to the Terms, by email, regular mail, social media postings, and posting on or within the Services, or other reasonable means now known or hereafter developed.
The Terms constitute the entire agreement between ECi and you with respect to your access to or use of the Services and Materials and supersede any prior agreements between you and ECi on such subject matter.
You may not assign or otherwise transfer the Terms, or any right granted hereunder, without ECi’s written consent. ECi’s rights under the Terms are freely transferable by ECi.
If for any reason a court of competent jurisdiction finds any provision of the Terms, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to affect the intent of the parties as reflected by that provision, and the remainder of the Terms shall continue in full force and effect.
Any failure by ECi to enforce or exercise any provision of the Terms, or any related right, shall not constitute a waiver of that provision or right.
Please report any violations of the Terms via the report abuse mechanism offered in conjunction with the specific Service in which the alleged violation occurs.
